Digital Notary Desk ("we," "us," or "our") is committed to protecting the privacy and security of the personal information you share with us. As a Virginia-authorized Remote Online Notary (RON), we handle your data with the highest level of care and in strict accordance with Virginia Code § 47.1.
2. Information We Collect
To perform legally binding notarial acts, we must collect and process certain Personally Identifiable Information (PII), including:
Contact Information: Name, email address, phone number, and mailing address.
Identification Data: Images of government-issued photo IDs, Social Security numbers (for Knowledge-Based Authentication/KBA), and birthdates.
Transaction Data: The documents being notarized and the details of the transaction.
Audio-Video Recordings: A complete recording of the remote notarization session as required by law.
3. Use of Third-Party RON Platforms
We utilize specialized third-party Remote Online Notarization (RON) platforms (including, but not limited to, Proof, BlueNotary, and OneNotary) to conduct secure sessions.
Independent Policies: These platforms have their own dedicated privacy and data-retention policies. By using our services, you acknowledge that your data will be processed through these third-party systems.
Data Flow: We do not own or control the underlying infrastructure of these third-party platforms and are not responsible for their independent data practices.
4. Data Retention & Legal Compliance
Pursuant to Virginia Code § 47.1-14, we are legally required to maintain a secure electronic journal and a recording of every RON session for a minimum of five (5) years.
Exclusive Control: These records are kept under the Notary’s exclusive control.
Limited Access: Records are only accessible for lawful inspection by the Secretary of the Commonwealth, pursuant to a court order, or upon written request by a party to the transaction.
5. Security & Protection
We implement industry-standard administrative and technical safeguards to protect your PII. However, no method of transmission over the internet is 100% secure.
Limitation of Liability: Digital Notary Desk is not liable for any unauthorized access, data breaches, or technical failures occurring on third-party platforms or due to the user's insecure internet connection or hardware.
6. Sharing of Information
We do not sell, rent, or trade your personal information. Data is shared only with:
Third-party platforms necessary to complete the notarization.
Payment processors to fulfill your transaction.
Legal or regulatory authorities when required by law.
7. Your Rights
You may request a copy of your specific notary journal entry or session recording by contacting us in writing. A processing fee may apply for record retrieval.
